Talk To Me Thursday!

So you know what day it is so let's talk it up! Let us know what is on your mind and we will discuss it. And also by way of request from Tuesdays conversation here is your add for today:

  1. OK here is a really good one. This Question is from someone I know which I didn't tell her that I was posting her question that she asked me but oh well you know me (I Do What I Want)

    Hypothetical question for you all. Say for whatever reason you had a title and you decided to switch shifts and your title would be taken and your pay cut. You agree to it sign a letter and everything. But your pay does not change. This goes on for sometime. You never mention it to your boss or the payroll department. Than you get a letter stating that they have been overpaying you for the past 5 months and they would be changing your pay and deducting the extra money you were given those past 5 months through a series of your paychecks. Would you be surprised and upset that they had the audacity to make such a mistake and now you have to pay for their mistake, would you seek another job, would you quit. What would you do?

  2. This was my answer to her:

    I would be a bit mad at myself or just suck it up. In that instance I only screwed myself by trying to get over on a mistake. A long time ago my job screwed up and paid everyone twice in one week. I knew that extra money wasn't mine. And my job didn't catch it for a week. So this one lady spent the money and the job eventually wanted it back. Well not only did she get fired but she was taken to court and sued!
    See getting over is one thing and sometimes you make out but Never try to get over and assume you will escape the consequences. A person can't really be mad at anyone but their self in my eyes anyway.

    It's natural to be a little upset, but the reality is, said person signed a legally binding contract. I can't tell you how many times I've seen mistakes in my payroll, and they have a right to adjust to fix their mistakes. Said person already agreed to it. Usually it's smart to mention it so that they can fix the problem ASAP, whether it's in your favor or not. Businesses don't play with their money, period. And they have auditors they go over all that crap, line-by-line.

    If said person doesn't like their job, I suppose it's good enough reason to seek employment elsewhere. But I'd stick it out until the new job is secured.

  5. I don't think I would be mad at the company. A mistake was made and I knew that it would probably be caught eventually.

    If my job made that mistake, I would probably would have told them after it happened. I would be worried about what my managers thought of the fact that I was taking the extra money and didn't say anything.

  6. @Linda - And what if Labor & Industry tells her that the company should let her keep the money? Then she's gotten the company in a situation with L&I AND she looks like a thief of some sort for taking money that she knows is not hers. Her reputation at the company would be in shambles at that point.

    I wouldn't advise that unless she plans on leaving.

  7. Why worry about what others think of you? If you are bold enough to take the money then you were a thief and it is what it is. But if their was a legal way that you could keep the money and you knew you couldn't pay it back then you might as well set that plan in to action rather than be deducted the money.

  8. You don't care what your manager thinks of you? I think that my manager having a positive opinion of me and him thinking I'm trustworthy and valuable employee is a good thing to have. Not someone who signs a contract and basically keeps money that does not belong to them. Why would I risk lowering future raises and bonuses for that? I'm thinking big picture....not just right now.

    Trying to keep money that you know you are not entitled to and still try and stay at the company is a dumb career move. Maybe if you work at Mickey D's, it's okay, but if you're making decent money and have a career vs. a job, it's dumb.

    Personally, this person ought to be happy that the job is not requesting a check for the lump sum ASAP. They're being nice taking it from a series of checks.

  9. She would only be making an inquiry not a complaint. They cannot contact the employer unless an official complaint is being made. In addition, the agreement they made her sign may not have been appropriate on their part. Without seeing the agreement and knowing the specifics I can only generalize on possibilities.

    (I was an executive board member to my union for 6yrs, so I have familiarity with L&I issues)

  10. Angel you are forgetting that people have rights! If you went to a attorney and they told you that you could keep the money then there is a Fing thing that your pissed off manager could do about it but have a smug look on their face every time they walk your way.
    People are sooo quick to throw their own rights out of the window! For instance if your boss decided to shaft you in this situation then that would be better for you because all you would need to do is to visit that same attorney and you will be receiving Mo Money Mo Money!

    So yeah I wouldn't be worried about my career being in jepody or people not liking me at all.

  11. .......... and if she did make a formal complaint against her employer and in turn they made it a hostile work environment for her, they would be in violation with that as well with L&I.

  13. @Linda - This person is not questioning the validity of the contract....she just wants to keep money that she thought the company mistakenly paid to her. The contract is not the issue.

    If L&I tells her that the company should pay her, an official complaint would be issued and the company would be notified. So now the company has an employee who signed a contract to take a pay cut, kept money that she felt was not hers, and is now jeopardizing future earnings for money she never expected to get. Hope she's got a sparkling conduct record and is not an at-will employee...lol

  14. 1 day...its driving me nuts!!! plus i hurt my back, went to work, but it hurts too much, so now going back Tuesday, since Monday i sign her up for school!!!! I can't wait, bought her a new phone, upgrade, for 27.00.....not a real up-grade, but a pretty cheap phone, so who cares...not me!!!!

  15. I am the Manager of Finance at my job and me being viewed as trustworthy is paramount. And me keeping CFOs, CEOs, and Exec VPs as good references is paramount for my future earnings at other companies as well. Keeping money that I NEVER thought I was entitled to is ridiculous in my opinion. That's some old $15/hr, get a job anywhere mentality.

    I like how ya'll have now changed this to this person being shafted when in the original post Anthony, you presented this as the person being fine with everything and taking money that didn't belong to them and you thought they were getting over! LMAO!!

  17. @Anthony - If this happened to me, like I said, I would have informed my company after the error. It's the right thing to do and would help me sleep at night. Plus my reputation and references are worth way more than however much money we're talking about.

My pay is always geting mess up and i know the company would never find out I work for a company that has 3 locations and i oversee a dept at each location so i get payed off the gross profit from each store and bonus are based off each stores performance i always tell them when they over pay me even though they will never know The last time they over payed they over payed me $1700 bucks it was real hard to tell them lol

  22. It takes a certain type of person that can spit in the wind and not look back! I can say that I had my fair share of doing harmful things and not caring who it effected but I could not do something like that to my job. I been here for too long and we are all like family. I been here for Almost eleven years now.

  23. @Anthony - Yeah, I couldn't do it either, whether I just started or been there for years. The contract was signed in good-faith, if I felt it was unfair, I wouldn't have switched my shift and signed it and inquired about the validity beforehand. I'm not going to take advantage of a mistake and then try and find a loophole to try and keep money I didn't think I should get anyway.

  28. @Justin I think I might stay in tonight. I have to ask her where else she is going for Friday and Saturday so I can roll one of those days.

    I might go to the movies tonight to see Case 39 with my wife tonight or just sit in the house and get my game on. I'm a bit tired from staying up late for the past two days with my boy that came over from out of town.

  32. what tonight or tues tues i didnt know i was going either it was my 1st time there delia ask me to come out tues night to meet saori and i thought it was a little bar so i was dressed for a bar lol it was real good i dont go out on tues alot but if i do im going there.

  33. I'm not sure I still want to go to the movies but I forgot it's Girls Night for my wife at her mom's house with her mom and sister. She already said that she would go to the movies tonight but I rather her spend her time with her family. But as for right now I don't think I'm going out tonight but I might just surprise myself by the end of the night. But the other thing that puts me off a bit about tonight is that it is suppose to be a whole hell of raining tonight all the way into the morning and it is suppose to rain HARD!

  37. @Angel ... the validity of the contract may be in question, they may not have been able to do that legally. In some situations, a pay cut is not allowed if the job change was not via a disciplinary action. In addition, unless she agrees to filing a formal complaint with L&I, they cannot pursue it, regardless of it's validity.

  42. @Linda - The validity of the contract was never an issue. It's almost like looking for something to get back at the company for because the employee got caught keeping money they shouldn't have. It's a lot of maybes, in some situations, some jobs, etc. etc.. How about maybe her manager is racist or sexist, she should contact the EEOC.

    In regards to the actual problem that Anthony posted, the employee really shouldn't be upset about having to pay the money back, IMO.
